Governing Laws: Prevention of Electronic Crimes Act (PECA) 2016, Electronic Transactions Ordinance (ETO) 2002, Anti-Money Laundering (AML) Act 2010 (Pakistan); Personal Information Protection and Electronic Documents Act (PIPEDA) (Canada); GDPR (UK/EU).

1. Introduction & The "Digital-Only" Mandate

Bizoso Consulta is committed to protecting your privacy and personal data. As a "totally electronic company," we operate on a strict paperless model. By accessing our portal, you acknowledge this digital-first approach. This policy governs how we collect, handle, and secure your data across our global administrative hubs in Pakistan, Canada, and the United Kingdom.

2. Information We Collect (The Digital Audit Trail)

To provide secure and compliant services, we collect the following data:

  1. Personal & Identity Information: Name, email address, phone number, CNIC/national ID, passport details, and relevant biometric verifications (e.g., video liveness checks).

  2. Financial & Transactional Data: Billing information, payment receipts, B2B partner NTN details, and corporate bank statement headers (Note: We do not store full credit card numbers on our servers; payments are processed via secure gateways like Stripe or EFT).

  3. Technical & Metadata Logs: Your Unique IP Address, browser fingerprint, timestamps, and device IDs are automatically logged for every login and document upload to ensure Non-Repudiation under the ETO 2002.

  4. Communication Records: Transcripts of your interactions with our portal and digital ticketing system.

3. The "Fraud & Forgery" Exception (CRITICAL NOTICE)

Privacy is a fundamental right reserved for honest applicants. Your right to confidentiality and data protection is automatically waived if Bizoso Consulta detects:

  • Document Forgery: The submission of altered, tampered, or fake bank statements, job letters, degrees, or identification.

  • Misrepresentation: Providing intentionally false information to manipulate immigration or business processes.

The Consequence: Under Section 14 of PECA 2016, Bizoso Consulta acts as a compliance gatekeeper. We are legally obligated to proactively disclose your data—including your identity, IP logs, and the fraudulent documents—to the Federal Investigation Agency (FIA) Cybercrime Wing, local law enforcement, and relevant Embassy Integrity Units. We will cooperate fully with any criminal investigation into your file.

4. How We Use & Share Your Information

We use your data strictly for legitimate business and legal purposes:

  • Service Delivery: To assess eligibility, prepare files, and share necessary information with independent, third-party licensed legal professionals (Attorneys/RCICs) bound by their own confidentiality agreements.

  • Compliance & Security: To meet legal obligations under the AML Act 2010, ensuring all financial flows are transparent and originate from legitimate sources.

  • Communication: To respond to your inquiries, provide case updates, and deliver necessary administrative notices.

5. Cross-Border Data Transfers

Bizoso Consulta operates on a secure global infrastructure. By using our services, you provide irrevocable consent for your personal data to be transferred, processed, and stored across international borders (including Pakistan, Canada, the US, and the UK). All data is encrypted in transit (SSL/TLS) and at rest to comply with PIPEDA and international data protection standards.

6. Data Retention & The 7-Year "Legal Hold"

In compliance with the Qanun-e-Shahadat Order (QSO) 1984 and global tax regulations, we retain your information for 5 to 7 years following the conclusion of your service.

  • Evidence Preservation: Data, including metadata and IP logs, is retained to serve as primary digital evidence in the event of an audit, dispute, or legal inquiry.

  • Legal Hold: We will not delete data upon request if the file is subject to a "Legal Hold" due to suspected fraud, ongoing litigation, or an active law enforcement investigation.

7. Your Rights & Security Responsibilities

Under applicable data protection laws, you have the right to request access to or correction of your personal data. However, these rights are subject to our strict security protocols:

  • Credential Security: You are solely responsible for keeping your portal login credentials secure. Any action taken or document uploaded under your account is legally attributed to you.

  • No Unauthorized Channels: We do not recognize, process, or protect data shared with employees via personal social media (e.g., personal WhatsApp) or unauthorized cash transactions. Only data submitted through the secure Perfex CRM Portal is protected under this policy.

8. Anti-Defamation & Cyber-Ethics

Any attempt to use "privacy concerns" as a threat to blackmail the firm, or to post defamatory, false, or misleading content on social media/review platforms, is a violation of Section 20 of PECA 2016. We reserve the right to utilize your stored metadata, communications, and IP logs to defend our firm’s reputation in a court of law.
