JURISDICTION, CHOICE OF LAW & DISPUTE RESOLUTION POLICY

Legal Foundation: The Contract Act 1872; The Arbitration Act 1940; The Electronic Transactions Ordinance (ETO) 2002; Prevention of Electronic Crimes Act (PECA) 2016.
1. Governing Law & Choice of Law
All digital contracts, terms of service, policies, and financial transactions originating from, or processed through, the Bizoso Consulta Pakistan portal (pk.bizoso.ca) are governed exclusively by the federal and provincial laws of the Islamic Republic of Pakistan.
By engaging our services, the Client explicitly agrees that Pakistani law shall apply to all agreements, without regard to any conflict of law principles or the Client's physical country of residence at the time of utilizing the portal.
2. Mandatory Internal Mediation (Condition Precedent)
Bizoso Consulta is committed to resolving grievances professionally and efficiently. To prevent frivolous litigation and unnecessary legal costs, the Client agrees to a Mandatory Internal Mediation Process as a strict condition precedent before initiating any external legal action.

The Process: Any dispute, grievance, or claim for a refund must first be submitted formally via the secure Digital Ticketing System on the Client's portal dashboard.

The Timeline: Bizoso Consulta requires a mandatory 30-day review and mediation period, commencing from the date the ticket is officially acknowledged by our compliance team.

Prohibition of Premature Action: The Client explicitly waives the right to file a complaint with any Consumer Court, the FIA, or civil court until this 30-day internal mediation period has been fully exhausted and a final "Deadlock Notice" has been issued by the firm.
3. Exclusive Legal Jurisdiction & Venue
In the event that a dispute cannot be resolved through the mandatory internal mediation process, the Client irrevocably agrees that any resulting legal proceedings, civil claims, or litigation shall be brought exclusively before the competent civil courts located in Karachi, Sindh, Pakistan.

The Client formally submits to the exclusive personal and subject-matter jurisdiction of the courts of Karachi.

The Client waives any objection to this venue based on forum non conveniens (claiming the location is inconvenient).
4. Admissibility of Digital Evidence & Non-Repudiation
As Bizoso Consulta is a "totally electronic company," physical signatures and paper contracts are not utilized.

ETO 2002 Compliance: Pursuant to the Electronic Transactions Ordinance 2002, the Client agrees that all electronic records—including but not limited to IP access logs, CRM audit trails, digital timestamps, uploaded document metadata, and electronic checkbox consents—are fully admissible as primary and conclusive evidence in any court of law, arbitration, or regulatory proceeding.

Waiver of Objection: The Client expressly waives any right to object to the validity, enforceability, or admissibility of these digital records simply because they are in electronic form. The Client cannot repudiate (deny) an action taken under their securely logged-in account.
5. Prohibition of Public Defamation & Social Media Disputes
Disputes must be handled through proper, confidential legal and administrative channels.

The Client agrees not to use public social media platforms (Facebook, Google Reviews, WhatsApp Groups, X/Twitter, etc.) as a tool to negotiate disputes, bypass the mediation process, or intentionally damage the firm’s commercial reputation.

Publishing false, misleading, or premature defamatory statements regarding a pending dispute is a violation of Section 20 of PECA 2016. Bizoso Consulta reserves the right to present the Client's digital logs to the authorities and pursue criminal defamation charges or civil damages against any such actions.
6. Severability Clause
If any provision of this Jurisdiction & Dispute Resolution Policy is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that specific provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of this agreement will remain in full force and effect.
