LIMITATION OF LIABILITY & DAMAGE WAIVER POLICY

1. Absolute Financial Liability Cap

Bizoso Consulta acts strictly as an administrative facilitator. While we execute our duties with the highest professional standards, the Client agrees that human or technical errors can occur.

In the highly unlikely event of a proven administrative error, omission, or breach of service that is directly, solely, and undeniably caused by the staff of Bizoso Consulta, the firm’s total aggregate liability shall be strictly capped at the exact amount of the "Facilitation Fee" paid by the Client to Bizoso Consulta for that specific service module.

Under no circumstances will Bizoso Consulta’s financial liability exceed the professional service fee actually received by the company.

2. Exclusion of Third-Party and Government Fees

Bizoso Consulta’s liability cap applies only to our internal professional fees. The Client acknowledges and agrees that Bizoso Consulta is completely exempt from refunding, reimbursing, or compensating the Client for external or third-party expenses.

These strictly non-recoverable expenses include, but are not limited to:

  1. Government visa application fees, biometric fees, or immigration surcharges.

  2. Fees paid to independent third-party legal professionals, Attorneys, or RCICs.

  3. Courier, postage, and physical document retrieval fees.

  4. Credential evaluation fees (e.g., WES, IQAS) or degree attestation fees (e.g., HEC, MOFA).

  5. Medical examination fees required by embassies.

3. Complete Waiver of Consequential and Indirect Damages

By registering on the Bizoso Consulta portal (pk.bizoso.ca) and engaging our digital services, the Client explicitly and irrevocably waives the right to sue, initiate consumer court complaints, or claim financial compensation for any consequential, indirect, special, punitive, or incidental damages.

This comprehensive waiver specifically bars the Client from claiming:

  1. Mental Agony & Emotional Distress: The Client formally waives the right to claim financial damages for psychological stress, anxiety, or emotional hardship resulting from a visa refusal, a government processing delay, or an administrative error.

  2. Opportunity Loss: The Client waives all claims for loss of potential income, forfeited business contracts, lost investments, or revoked university/employment offers due to a negative or delayed immigration outcome.

  3. Incidental Travel Costs: The Client waives claims for non-refundable flight tickets, hotel bookings, conference registration fees, or relocation expenses lost due to an embassy decision. (Bizoso Consulta officially advises all clients NEVER to finalize non-refundable travel arrangements until a visa is physically affixed to their passport).

4. Force Majeure (Uncontrollable Events) Exemption

Bizoso Consulta shall not be held liable for any failure or delay in fulfilling its obligations if such failure is caused by events beyond the firm’s reasonable control.

The Client waives the right to hold Bizoso Consulta liable for delays or damages arising from:

  1. Acts of God, natural disasters, or global pandemics.

  2. Sovereign government actions, embassy closures, or sudden changes in immigration law.

  3. Strikes, civil unrest, or telecommunication/internet blackouts in Pakistan or the destination country.

  4. Cyber-attacks, unauthorized third-party server breaches, or prolonged downtime of government portals (e.g., IRCC or USCIS website crashes).

5. Client Indemnification of Bizoso Consulta

The liability protection is mutual. If the Client submits fraudulent documents, forged bank statements, or misrepresents their profile, and this action results in an investigation, legal penalty, or reputational damage to Bizoso Consulta, the Client agrees to fully indemnify and hold harmless the firm.

The Client shall be entirely responsible for covering Bizoso Consulta’s legal defense fees, corporate fines, and associated costs arising from the Client's fraudulent actions.

6. Digital Consent and Legal Enforceability

By accessing the secure portal, clicking "I Agree," or rendering payment, the Client formally acknowledges:

  1. They have read, understood, and accepted this Limitation of Liability & Damage Waiver Policy in its entirety.

  2. They understand they are giving up substantial legal rights, specifically the right to sue for amounts exceeding the Facilitation Fee.

  3. This digital consent is legally binding and fully enforceable under the Electronic Transactions Ordinance (ETO) 2002.
