ELECTRONIC TRANSACTIONS & E-SIGNATURE POLICY
Policy Code: BIZ-PK-ESIGN-2026
Effective Date: March 28, 2026
Portal Application: pk.bizoso.ca | www.bizoso.ca
Jurisdiction: Islamic Republic of Pakistan
Legal Foundation: Electronic Transactions Ordinance (ETO) 2002 (Sections 3, 4, 7, and 8); Qanun-e-Shahadat Order (QSO) 1984 (Article 164); The Contract Act 1872.
1. Legal Recognition of Electronic Records (ETO Section 3)
Bizoso Consulta operates as a fully digital, paperless administrative facilitation firm. Pursuant to Section 3 of the Electronic Transactions Ordinance (ETO) 2002, the Client explicitly acknowledges and agrees that no contract, policy, agreement, or communication shall be denied legal validity, enforceability, or binding effect solely on the ground that it is in electronic form.
All terms, conditions, and agreements hosted on the pk.bizoso.ca portal hold the exact same legal authority as traditional, physical paper contracts.
2. Validity of Electronic Signatures (ETO Section 7 & 8)
Bizoso Consulta does not utilize or require physical "wet-ink" signatures for its service agreements, affidavits, or policy consents.
-
The E-Sign Definition: The Client legally agrees that completing the digital onboarding process, clicking an "I Agree" button, checking a mandatory consent box, typing their name into a digital field, or remitting a digital payment through the Perfex CRM constitutes a valid, binding Electronic Signature.
-
Legal Equivalency: Under Sections 7 and 8 of the ETO 2002, this electronic signature satisfies any legal requirement for a document to be signed or authenticated. It carries the exact same judicial weight as a physical signature witnessed and stamped by a Notary Public.
3. Absolute Non-Repudiation & User Accountability
Once a digital action is taken within the Client’s secure portal, it cannot be undone or legally denied.
-
Authentication Binding: The Client’s electronic signature is permanently cryptographically linked to their unique digital identity within the CRM, including their verified email address, IP address, and secure login credentials.
-
Waiver of Repudiation: The Client expressly waives any legal right to repudiate (deny) their signature or claim that they "did not read," "did not understand," or "did not physically sign" the agreements on the portal.
-
Account Security: The Client is solely responsible for maintaining the absolute secrecy of their portal password. Any electronic signature executed, or document uploaded under the Client’s logged-in session is legally deemed to have been executed by the Client themselves.
4. Primary Evidence Admissibility (QSO 1984)
To protect the firm from frivolous litigation or fraudulent chargebacks, Bizoso Consulta maintains rigorous digital audit trails.
-
Pursuant to Article 164 of the Qanun-e-Shahadat Order (QSO) 1984 and the ETO 2002, the Client agrees that Bizoso Consulta’s CRM server logs, digital timestamps, IP tracking data, and electronic consent records are fully admissible as primary and conclusive evidence in any civil court, regulatory tribunal, or law enforcement inquiry.
-
The Client cannot object to the introduction of these digital records as evidence on the basis of them being electronic rather than physical.
5. Electronic Delivery & Constructive Notice
The Client agrees to receive all legal notices, case updates, policy changes, and invoices electronically.
-
Constructive Receipt: A notification, ticket, or invoice is legally deemed "delivered" and "read" by the Client the exact moment it is dispatched by Bizoso Consulta’s CRM to the Client’s registered email address or posted to their secure portal dashboard.
-
Spam/Junk Folders: Bizoso Consulta assumes zero liability if the Client fails to read a critical update because the electronic notification was routed to a spam or junk folder. It is the Client's strict legal responsibility to monitor their digital portal regularly.
6. Severability & Survival
If any provision of this E-Signature Policy is found to be contrary to local law by a court of competent jurisdiction, that specific provision shall be modified to the minimum extent necessary to make it enforceable, while the overarching legality of the digital contract and the remaining provisions shall survive and remain in full force.
