DIGITAL CONSENT & DATA PROCESSING AGREEMENT

Legal Foundation: Prevention of Electronic Crimes Act (PECA) 2016; Electronic Transactions Ordinance (ETO) 2002; General Data Protection Regulation (GDPR - EU/UK); Personal Information Protection and Electronic Documents Act (PIPEDA - Canada).
1. Explicit Digital Consent & Scope of Collection
By registering an account on the secure Perfex CRM portal (pk.bizoso.ca), uploading documents, or clicking the mandatory "I Agree" checkbox during onboarding, the Client provides explicit, fully informed, and legally binding consent for Bizoso Consulta to collect, store, and process their highly sensitive personal data.
Pursuant to the Electronic Transactions Ordinance (ETO) 2002, this digital consent is irrevocable for the duration of the active service contract. The scope of data collected includes, but is not limited to:

Biometric & Identity Data: Passport scans, CNIC/NICOP, facial video verification (Liveness checks), and physical identifiers.

Financial Data: Bank statements, tax returns (FBR/NTN), asset valuations, and credit/payment histories.

Familial & Background Data: Marriage certificates, birth certificates, travel histories, and employment records.

Digital Metadata: IP addresses, browser fingerprints, login timestamps, and CRM audit trails.
2. Purpose of Processing & Lawful Basis
Bizoso Consulta acts as a Data Controller and Processor. We collect and process the Client’s data strictly for the following lawful purposes:

Administrative Facilitation: To meticulously prepare, compile, and submit visa, immigration, or corporate applications to sovereign governments.

Legal & Financial Compliance: To execute mandatory Know Your Customer (KYC) and Anti-Money Laundering (AML) background checks.

Fraud Prevention: To utilize metadata and digital chain-of-custody logs to verify the authenticity of uploaded documents.
3. Authorized Third-Party Sharing & Cross-Border Transfer
Because Bizoso Consulta operates on a global scale (with hubs in Pakistan, Canada, the UK, the USA, Malaysia, and Indonesia), the Client explicitly consents to the cross-border transfer of their data.
The Client authorizes Bizoso Consulta to digitally transmit and share their compiled data with the following specific third parties:

Sovereign Governments: Immigration, Refugees and Citizenship Canada (IRCC), UK Visas and Immigration (UKVI), USCIS, and the respective embassies evaluating the file.

Verification Partners: Universities, banking branch managers, and employers strictly for the purpose of executing a Third-Party Verification (TPV) Audit.

Licensed Legal Partners: Authorized Regulated Canadian Immigration Consultants (RCICs) or immigration attorneys retained to represent the Client's specific file.
4. The "Fraud Exception" to Data Privacy
Bizoso Consulta fiercely defends its corporate licensing. The Client explicitly acknowledges that data privacy is a fundamental right strictly reserved for lawful, honest applicants.
If Bizoso Consulta’s compliance team, or a third-party verification audit, detects that the Client has uploaded forged documents, fabricated financial records, or engaged in identity spoofing:

The Client’s right to data privacy is immediately and permanently revoked.

Under Section 14 of PECA 2016, Bizoso Consulta is legally obligated to hand over the Client’s complete digital footprint, unredacted documents, and IP logs directly to the Federal Investigation Agency (FIA) Cybercrime Wing and relevant Embassy Integrity Units.

The Client waives all rights to claim a breach of confidentiality in the event of this mandatory law enforcement disclosure.
5. Data Retention & The Limitations of the "Right to be Forgotten"
While Bizoso Consulta respects international frameworks like the GDPR, the Client’s "Right to be Forgotten" (requesting the deletion of their data) is strictly subject to legal and regulatory limitations.

Standard Post-Decision Purge: To optimize server security, Bizoso Consulta will permanently and irreversibly delete the Client’s uploaded documents and compiled forms from our active servers exactly 90 Days after a final decision (Approval, Refusal, or Abandonment) is reached.

The Anti-Evasion Clause (Denial of Deletion): A Client cannot invoke the "Right to be Forgotten" to hide evidence of a crime. If a file is currently under investigation for document fraud, or if the Client has initiated a malicious chargeback or legal dispute, Bizoso Consulta will refuse the deletion request.

The data will be placed on a "Legal Hold" and retained indefinitely until the FIA inquiry, embassy investigation, or civil litigation is fully resolved.
6. Limitation of Liability for Cyber Incidents
Bizoso Consulta utilizes enterprise-grade encryption and secure CRM architecture to protect Client data. However, the Client acknowledges that no digital system connected to the internet is 100% immune to sophisticated state-sponsored cyber-attacks or unforeseen zero-day vulnerabilities.

By utilizing the portal, the Client accepts the inherent risks of digital data transmission.

In the highly unlikely event of an unauthorized third-party server breach or cyber-attack that bypasses our security protocols, the Client explicitly waives the right to hold Bizoso Consulta financially or legally liable for the resulting data exposure, provided the firm was maintaining standard industry security practices at the time of the breach.
