1. The Digital Surveillance & Logging Mandate

To ensure absolute operational transparency, protect corporate integrity, and defend against fraudulent claims, Bizoso Consulta maintains a continuous, unalterable background tracking system within the Perfex CRM portal (pk.bizoso.ca).

By registering an account and accessing the portal, the Client explicitly consents to the continuous collection, encryption, and storage of their digital metadata. The system automatically captures and logs:

  • Network Data: The originating Public IP Address, Internet Service Provider (ISP), and geolocation for every login session.

  • Device Footprinting: The MAC address profile, operating system, browser type, and screen resolution used to access the portal.

  • Action Timestamps: Cryptographic, server-side timestamps (recorded to the exact second in UTC/PKT) detailing exactly when an account was accessed, a document was uploaded, a digital signature was applied, or a message was read.

2. The Principle of Absolute Non-Repudiation

In digital law, "Non-Repudiation" means a party cannot deny the authenticity of their signature or the fact that they sent a message or authorized an action.

Bizoso Consulta enforces strict Non-Repudiation protocols:

  • Identity Binding: All actions performed within the pk.bizoso.ca portal are permanently and legally bound to the specific, password-protected account of the registered Client.

  • Waiver of Denial: The Client legally waives the right to claim that an action executed under their logged-in session was done "by mistake," "by a hacker," or "by a third party without permission."

  • The "I Didn't Read It" Defense: If the CRM audit trail shows that a Client opened a document, clicked "Approve," or checked a consent box, the Client cannot later argue in court or mediation that they were unaware of the contents.

3. Primary Evidence Admissibility (Article 164, QSO 1984)

Fraudulent applicants or disputing clients often attempt to rely on verbal arguments or physical affidavits to contradict digital realities. This policy legally neutralizes that tactic.

  • Conclusive Evidentiary Weight: Pursuant to Article 164 of the Qanun-e-Shahadat Order (QSO) 1984 (which permits the courts to receive any evidence that may have become available because of modern devices or techniques), and supported by the ETO 2002, the Client formally agrees that Bizoso Consulta’s CRM audit logs are fully admissible as primary, conclusive, and irrefutable evidence.

  • Supremacy of Digital Logs: In the event of any arbitration, consumer court hearing, or civil litigation, the Client agrees that the unalterable digital server logs generated by Bizoso Consulta shall completely supersede and override any conflicting verbal testimony or physical claims made by the Client.

4. Account Security & Liability Transfer

The integrity of the Digital Audit Trail relies on the Client keeping their portal access completely secure.

  • The Client is the sole custodian of their login credentials (Username, Password, and any 2FA codes).

  • Prohibition of Credential Sharing: The Client is strictly forbidden from sharing their portal password with family members, external travel agents, or third-party "consultants."

  • Complete Assumption of Liability: If the Client intentionally or negligently shares their login credentials, and a third party uses those credentials to upload forged documents or authorize illegal actions, the Client remains 100% criminally and financially liable for those actions under the law. Bizoso Consulta will prosecute the account holder of record.

5. Anti-Fraud & Law Enforcement Integration (PECA 2016)

Bizoso Consulta will weaponize its Digital Audit Trail to aggressively defend its corporate licensing against individuals attempting to commit visa fraud or financial crimes.

  • The "Smoking Gun" Protocol: If document forgery, identity spoofing, or a fraudulent credit card chargeback is detected, the CRM's IP Logging and Action Timestamps serve as the definitive proof of the Client's guilt.

  • Proactive Handoff: Under PECA 2016, Bizoso Consulta reserves the irrevocable right to instantly export the Client’s complete Digital Audit Trail—including all IP addresses, device footprints, and upload timestamps—and hand it directly to the Federal Investigation Agency (FIA) Cybercrime Wing, the relevant Embassy Integrity Units, and local law enforcement without prior notice to the Client.
